These General Terms and Conditions are legally binding between you and Elevateyourself AB, org. no. 559393-2998 (“Elevateyourself”) and govern your use of the digital service "Heyey" ("the Service") provided by Elevateyourself.
The Service is provided through the website www.heyey.se ("the Website") and trough the mobile application ("the App"). You get access to the service by creating an account.
The General Terms and Conditions and the Privacy Policy together constitute the agreement between you and Elevateyourself.
Please note that you must read and accept the General Terms and Conditions of the Service and Elevateyourselfs Privacy Policy before using the Service. You will find a link to Elevateyourself's Privacy Policy at the bottom of the page.
1.1. To access the Service, you need to accept the General Terms and Conditions and the Privacy Policy in full as well as create a user account. By accepting and creating a user account, you confirm that you are at least 18 years old, or that you have parental consent to enter into an agreement with Elevateyourself. You also confirm that the information you provide when creating your user account is true, accurate and complete, that you will update the information to keep it current, and that you accept these General Terms and Conditions, the current Privacy Policy and, where applicable and advertised, that parts of the content in the Service or the Service as a whole may be or become paid services.
1.2. You are welcome to use the Service if you are under 18 years old, but only if you have parental consent.
1.3. You are responsible for all actions taken under your User Account. If you have reason to believe that there has been unauthorized access to your User Account, please immediately change your password and, where applicable, notify Elevateyourself.
2.1. To access the service, you log in with your username and password.
2.2. The website and app specify the range and prices of the service that are offered from time to time.
2.3. You have the possibility to access the content in the service or parts of the service you have chosen through your user account on the types of devices that are supported.
2.4. You are responsible for ensuring that your mobile device is updated with the software required from time to time to access the service.
2.5. You are always responsible for any internet fees and charges for data traffic that may apply when using the service.
3.1. You agree that it is prohibited to:
Copy, reproduce, record, make available to the public or otherwise dispose of any part of the Service or its content in a way that is not expressly permitted under these Terms and Conditions.
Engage in "reverse engineering" or create software that is dependent on or derived from the Service or any part thereof.
Attempt to gain unauthorized access to the app, website, server on which they are stored or any server, computer or database connected to them.
Intentionally introduce viruses, trojans, internet worms, logic bombs or other material that is intended to cause harm or is otherwise technically harmful.
Attack the Service through Denial of Service attacks, including but not limited to, overload attacks.
4.1. The service may be supported by advertising or through marketing from third parties, and also partially or in full through one-time purchases. The service may also partially or in full consist of a subscription. In the subscription, you will receive ongoing access to the content included in the subscription. Elevateyourself may also change the subscription format from time to time, including adding new subscription formats.
4.2. Prices for one-time purchases or for subscriptions are always communicated in the app before the purchase. Where applicable, prices are displayed in the current currency and include VAT for one-time purchases or subscriptions that target private individuals, and exclude VAT for one-time purchases or subscriptions that target business customers.
4.3. Elevateyourself may change the price of a one-time purchase or a subscription from time to time. Any price changes will take effect when the current period (i.e. the period you have already paid for) expires. New prices are always communicated in the app and, if necessary, also through the website or the contact details you provided when registering your user account. If you do not agree to the change in the subscription price, you can cancel the subscription in accordance with section 6.1. If you continue to use the service after being informed of the new price, it means you accept the new price.
4.4. Payment shall be made through the payment methods offered by Elevateyourself from time to time. Payment is made in advance. For certain one-time purchases or subscriptions that are part of campaigns run by Elevateyourself or a partner of Elevateyourself, payment may be required to be made in a certain way or through the partner (such as by invoice). Payment methods and terms of payment are then specified in the terms and conditions of the campaign or partnership in question.
4.5. If you pay by account or with credit card, the fee will be charged on the same calendar day as the one-time purchase or subscription was made. Your potential subscription will then be automatically renewed at the beginning of each new subscription period unless you terminate your subscription before the subscription period expires in accordance with the termination provisions in section 6.1 or unless Elevateyourself revokes your access in accordance with section 6.2.
4.6. If the fee for the one-time purchase or subscription cannot be debited on the same calendar day in a particular month, for example if the billing day does not fall on a banking day, the fee will be debited on the next banking day.
4.7. To have uninterrupted access to the content included in your selected subscription, you are obliged to ensure that you have paid according to the payment method applicable for the current subscription. If you pay by bank or with credit card, you are obliged to ensure that there are sufficient funds in your account to pay the fee for each new subscription period. If the fee cannot be debited, Elevateyourself will send you a message about it and make a new attempt to execute the transaction. Such a new attempt is made every day for 5 banking days. Your access to the content in the service will automatically cease if the fee has not been paid after this final attempt.
5.1. As the content of the service is digital and not delivered on a physical medium, there is no right of withdrawal. By creating a user account or subscribing, you agree that you have no right of withdrawal for your purchase. However, you always have the right to terminate your user account or subscription in accordance with section 6.1.
6.1. The duration of different Subscriptions may vary. You may terminate your Subscription at any time via your User Account or by contacting Elevateyourself. To prevent the next Subscription period from commencing, you must terminate your Subscription at least 24 hours before the start of the next Subscription period. The termination will take effect when the Subscription period for which you have already paid expires.
6.2. Elevateyourself reserves the right to terminate the Agreement and deactivate your User Account at any time in case of unauthorized use or suspected unauthorized use of the service or in case of suspicion of violation of these Terms and Conditions. In such termination and deactivation, Elevateyourself has no responsibility or obligation towards you, and Elevateyourself will not refund any already paid amounts.
6.3. Temporary suspension from the service may occur in case of absence of cover for the subscription fee or due to circumstances beyond Elevateyourselfs control, see further under section 10.1.
7.1. If the service is defective, you have the right to make a complaint about your purchase. If you want to make such a complaint, you should notify us within a reasonable time after discovering the defect. You may then have the right to demand remedy, redelivery, price reduction, or compensation for remedying the defect, or in serious cases, the right to cancel the purchase and get a refund. You may also have the right to claim damages.
7.2. If you believe that the service is defective, you should send a message to Elevateyourself describing the defect.
8.1. The use of the service and its content is at your own risk. To the extent permitted by applicable law, Elevateyourself does not provide any warranties, express or implied, regarding the quality, content, availability, or fitness for a particular purpose of the service. Elevateyourself further disclaims any warranties, makes no representations, and assumes no liability for any other products or services advertised or offered by third parties through the service or through a linked website or displayed on a banner or advertised in any other way.
9.1. Elevateyourselfs liability under this Agreement is limited to the annual value of the service you subscribe to.
9.2. Neither party shall be liable for indirect damages such as loss resulting from reduction or loss of production or turnover, loss of profit or other similar loss.
10.1. Elevateyourself will take reasonable measures to keep the service running, and the service is normally available 24 hours a day, every day of the week. However, technical difficulties, maintenance, security updates, improvements or similar actions, as well as force majeure events, may from time-to-time result in unsatisfactory service or total or partial unavailability.
10.2. Elevateyourself is constantly striving to improve the service and reserves the right to update and/or change the service at any time without notice of the change.
11.1. You agree that Elevateyourself collects and processes your personal data in accordance with Elevateyourselfs Privacy Policy presented on Elevateyourself.se and in the app.
12.1. These General Terms and Conditions may be amended after you first accepted them. You undertake to stay informed and comply with the General Terms and Conditions applicable at any time.
13.1. By visiting the website and using the service, you consent to the use of cookies and similar technologies in accordance with our Privacy Policy presented in the app and on the website.
14.1. Elevateyourself may assign its rights and obligations under these General Terms and Conditions to a third party. You are not entitled to assign your rights or obligations under these General Terms and Conditions to a third party.

16.1. Swedish law shall apply to this Agreement.
16.2. In the event of a dispute with Elevateyourself, you have the right to turn to the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden) or the general courts.
